Obamacare Ruled Unconstitutional

U.S. District Judge Henry Hudson of Virginia ruled last Friday that the Obama health care law is unconstitutional. The portion in question is the section that requires us to purchase health insurance. The  Commerce Clause of the Constitution was cited as the reason for the judge’s ruling.

He did acknowledge that he expected his decision to be appealed, and the US Justice Department has already said they will do so.

It won’t be decided for real until (a) it goes to the US Supreme Court, or (b) the new Congress gets it repealed. Still, this is a good shot across the bow. It can’t hurt to have this decision when this goes to SCOTUS. Maybe by the time that happens it will be a moot point. We can dream.
